Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("AUP") governs your use of the UnlockMyLead platform and services ("Service"). It is incorporated into and forms part of our Terms of Service. Capitalized terms have the meanings given in the Terms of Service.

Violations of this AUP may result in immediate suspension or termination of your account without refund, and may expose you to legal liability.

2. General Principles

You must use the Service:

  • Lawfully, ethically, and in good faith
  • In compliance with all applicable laws in every relevant jurisdiction
  • With respect for the rights and privacy of others
  • In accordance with the Terms of Service and all our policies
  • Only for legitimate business communication purposes

You bear sole responsibility for ensuring your communications comply with all applicable laws and industry standards.

3. Prohibited Communications — Content

You may not use the Service to send or generate communications that:

3.1 Illegal Content

  • Promote, facilitate, or constitute illegal activity
  • Promote illegal drugs, illegal firearms, illegal gambling, or other illegal goods/services
  • Constitute criminal solicitation, conspiracy, or aiding-and-abetting
  • Violate sanctions, export controls, or trade restrictions

3.2 Harmful Content

  • Threaten, harass, stalk, intimidate, defame, or bully
  • Promote violence, terrorism, or extremism
  • Promote self-harm, suicide, or eating disorders
  • Constitute hate speech against protected groups
  • Sexually exploit, abuse, or endanger children (CSAM is strictly prohibited and will be reported to authorities)

3.3 Deceptive Content

  • Phishing, vishing, smishing, or any social engineering
  • Fraudulent or deceptive solicitations
  • Fake invoices, fake debt collection, fake legal threats
  • Pyramid schemes, Ponzi schemes, or "get rich quick" scams
  • Cryptocurrency fraud, fake investment opportunities
  • Romance scams, pig-butchering schemes
  • Impersonation of:
    • Government agencies (IRS, FBI, police, immigration, courts, etc.)
    • Banks, credit card companies, or financial institutions
    • Tech companies (Microsoft, Apple, Amazon, etc.)
    • Healthcare providers or insurance companies
    • Real individuals without their explicit prior written consent

3.4 Harmful AI Voice Use

  • Generating AI voices that imitate a specific real person without their explicit prior written consent
  • Voice cloning for deceptive, fraudulent, or harassing purposes
  • Creating "deepfake" audio designed to deceive

3.5 Spam and Bulk Communications

  • Unsolicited bulk communications without legally-required consent
  • Communications to recipients on Do Not Call (DNC) lists
  • Communications to recipients who have opted out
  • Communications outside permitted hours per recipient's local time

3.6 Commercial Restrictions

You may not use the Service for:

  • Political robocalls/messaging in jurisdictions where prohibited or restricted
  • Healthcare communications in violation of HIPAA or equivalent laws
  • Communications regarding tobacco, alcohol, or cannabis to minors or in restricted jurisdictions
  • Adult content or adult industry communications
  • Predatory lending or "payday loan" telemarketing in violation of state laws
  • Solicitations to vulnerable populations (elderly, ill, disabled) using deceptive practices

4. Prohibited Practices — Telephony and Messaging

You may not:

4.1 Caller ID and Identification

  • Spoof caller ID information in violation of the Truth in Caller ID Act, TRACED Act, or equivalent foreign laws
  • Use misleading caller ID information designed to confuse recipients
  • Hide your identity in violation of legal disclosure requirements
  • Bypass or disable STIR/SHAKEN authentication

4.2 Consent Violations

  • Make AI-generated calls without "prior express written consent" where required by TCPA
  • Send messages without required opt-in consent
  • Continue contacting individuals who have opted out
  • Falsify or fabricate consent records
  • Purchase or use contact lists where consent is not legally valid

4.3 Volume and Pattern Abuse

  • Conduct "war dialing," random dialing, or sequential dialing in violation of law
  • Generate excessive call volumes designed to overwhelm receivers
  • Engage in "call bombing" or telephony denial-of-service
  • Send messages designed to cause harm or distress through repetition

4.4 Restricted Numbers

  • Call emergency service numbers (911, 112, 999, etc.) for non-emergencies
  • Call prohibited numbers (e.g., toll-free callback scams)
  • Contact phone numbers without removing those on internal/external DNC lists

5. Prohibited Practices — Technical

You may not:

5.1 System Abuse

  • Reverse engineer, decompile, disassemble, or attempt to extract source code
  • Use automation, bots, or scripts to abuse the Service beyond its intended use
  • Probe, scan, or test vulnerabilities
  • Conduct penetration testing without prior written authorization
  • Bypass rate limits, usage caps, security features, or access controls
  • Access data, accounts, or systems you are not authorized to access
  • Disrupt servers, networks, or other users' use of the Service

5.2 Malicious Activity

  • Distribute malware, viruses, ransomware, spyware, or any harmful code
  • Use the Service to launch attacks (DDoS, MitM, SQL injection, etc.) against others
  • Engage in cryptojacking or unauthorized cryptocurrency mining
  • Conduct credential stuffing or brute-force attacks

5.3 Misuse of Integrations

  • Misuse CRM credentials beyond the scope authorized by their owner
  • Bypass CRM permission systems
  • Exfiltrate data from connected systems beyond legitimate business purposes

6. Prohibited Use — Business Practices

You may not:

6.1 Reselling Without Authorization

  • Resell, redistribute, or sublicense the Service except under a written White-Label Agreement
  • Misrepresent the Service as your own technology
  • White-label without complying with reseller obligations

6.2 Competing Use

  • Use the Service to build, train, or improve a directly competing AI calling, messaging, or sales automation product
  • Scrape, collect, or extract data from the Service for competitive purposes
  • Benchmark the Service for publication without prior written consent

6.3 Evasion

  • Create multiple accounts to evade limits, suspensions, or bans
  • Use VPNs, proxies, or other tools to evade geographic restrictions or sanctions
  • Provide false information during registration or verification

7. Industry-Specific Restrictions

7.1 Healthcare (HIPAA)

If you are a "covered entity" or "business associate" under HIPAA, you must:

  • Sign a Business Associate Agreement (BAA) with us before processing PHI
  • Configure the Service per HIPAA requirements
  • We currently do not sign BAAs and the Service is not HIPAA-compliant by default; do not use the Service to process Protected Health Information unless we have agreed otherwise in writing

7.2 Financial Services (GLBA, PCI)

You must comply with all applicable financial services regulations, including GLBA Safeguards Rule, FCRA, FDCPA, and PCI DSS where applicable.

7.3 Children (COPPA)

You may not use the Service to communicate with individuals under 13 (US) or to collect data from children. Where minors aged 13-17 are contacted, additional protections apply.

7.4 Political Communications

You must comply with FCC rules, state robocall laws, and equivalent foreign election laws. In some jurisdictions, AI-generated political calls are prohibited or heavily restricted.

7.5 Debt Collection (FDCPA)

Debt collectors must comply with FDCPA and state debt collection laws, including time-of-day restrictions, validation notices, and prohibitions on harassment.

8. Reporting Violations

If you become aware of a violation of this AUP:

  • Email: abuse@unlockmylead.com
  • Include details, evidence, and any relevant identifiers
  • We investigate all credible reports

We may share reports with law enforcement, regulators, or affected parties.

9. Enforcement

9.1 Our Rights

We may, at our sole discretion and without liability:

  • Investigate suspected violations
  • Suspend or terminate accounts immediately, with or without notice
  • Remove or block content, communications, or contacts
  • Withhold or claw back fees
  • Cooperate with law enforcement and regulators
  • Disclose user information as required by legal process or to protect against harm
  • Retain logs and evidence for investigation purposes

9.2 No Duty to Monitor

We have no obligation to pre-screen, monitor, or filter Customer communications. We may, but are not required to, review communications for AUP compliance.

9.3 Reporting to Authorities

Certain violations (CSAM, terrorism, imminent threats) will be reported to appropriate authorities without notice to you.

9.4 Legal Remedies

In addition to AUP enforcement, we reserve all legal remedies, including damages, injunctive relief, and recovery of attorneys' fees.

10. Indemnification

Per the Terms of Service, you agree to indemnify us for all claims arising from your violation of this AUP. This includes regulatory fines, lawsuits, and damages awarded against us.

11. Examples of Common Violations

For clarity, these are examples (non-exhaustive) of activities that violate this AUP:

  • Cold-calling US consumers using AI voices without "prior express written consent"
  • Sending WhatsApp messages to people who have not opted in under WhatsApp Business policy
  • Calling phone numbers from a purchased list without verifying consent
  • Pretending to be IRS, Microsoft, or a bank to extract personal information
  • Calling Do Not Call registered numbers for telemarketing
  • Sending messages at 3 AM local time
  • Cloning a celebrity's voice to record fake endorsements
  • Using the Service to deliver "robocall" political messaging in jurisdictions where prohibited
  • Operating a scam call center using our infrastructure
  • Reselling our service while claiming to have built the technology
  • Sharing API keys publicly or with unauthorized third parties
  • Stress-testing or load-testing the Service without permission

12. Updates to This AUP

We may update this AUP at any time. Material changes will be communicated as required by the Terms of Service. Continued use after the effective date constitutes acceptance.
